Please read these Terms and Conditions carefully before submitting a booking request through The Spot PH
website. By completing and submitting the online booking form, you acknowledge that you have read, understood,
and agreed to be bound by the following terms. These terms govern all reservations, contracts, payments, and
service engagements between The Spot PH and its clients.
1. DEFINITIONS
- "The Spot PH" refers to the mobile events bar business, its owner, admin personnel, and
authorized staff.
- "Client" refers to any individual, organization, or entity that submits a booking request
or enters into a service agreement with The Spot PH.
- "Booking" refers to a confirmed reservation for mobile bar services at a specified event
date, time, and venue.
- "Event" refers to the occasion for which the Client has booked the services of The Spot
PH, including but not limited to weddings, debuts, birthdays, and corporate functions.
- "Package" refers to any service bundle offered by The Spot PH as listed on the official
website.
- "Booking Form" refers to the online inquiry and reservation form available on The Spot PH
website.
- "Confirmation" refers to the written or electronic acknowledgment issued by The Spot PH
confirming acceptance of a booking.
- "Downpayment / Reservation Fee" refers to the partial payment required to secure a
booking date.
2. BOOKING PROCESS
All bookings with The Spot PH are subject to the following process:
- Step 1: The Client submits an inquiry or booking request through the official Booking
Form on The Spot PH website.
- Step 2: The Spot PH admin will review the submission and contact the Client within 24 to
48 hours to discuss event details, package selection, and availability.
- Step 3: A booking is considered tentative and not yet confirmed until the required
downpayment has been received and acknowledged by The Spot PH.
- Step 4: Upon receipt of the downpayment, The Spot PH will issue a written or electronic
Booking Confirmation to the Client.
- Step 5: The Client must review the Booking Confirmation details carefully and notify The
Spot PH of any discrepancies within 48 hours of receipt.
NOTE: Submitting the Booking Form does not guarantee reservation of the requested
date. Date availability is confirmed only upon issuance of the official Booking Confirmation.
3. PAYMENT TERMS
- 3.1 Downpayment: A non-refundable downpayment of fifty percent (50%) of the total package
price is required to secure the booking date. The exact amount will be stated in the booking agreement.
- 3.2 Balance Payment: The remaining balance must be settled in full no later than seven
(2) days before the scheduled event date, unless otherwise agreed upon in writing.
- 3.3 Payment Methods: The Spot PH accepts payments via GCash, Maya, bank transfer, and
cash. Payment details will be provided during confirmation.
- 3.4 Proof of Payment: The Client must send proof of payment (screenshot or receipt) to
The Spot PH admin immediately after each transaction for acknowledgment.
- 3.5 Price Adjustments: The Spot PH reserves the right to revise package prices. However,
prices confirmed in a Booking Confirmation will not be subject to change after issuance.
NOTE: Failure to complete the balance payment on the due date may result in
cancellation of the booking without a refund of the downpayment.
4. CANCELLATION AND RESCHEDULING POLICY
Cancellation by the Client
- Notice Period: 7 days or more before event — Downpayment forfeited; no additional
charges apply.
- Notice Period: 3 to 6 days before event — Downpayment forfeited; 25% of the total
package price will be charged.
- Notice Period: 1 to 2 days before event — Downpayment forfeited; 50% of the total
package price will be charged.
- Notice Period: Less than 24 hours before event — The full package price is due; no refund
will be issued.
Rescheduling by the Client
- 4.1 Clients may request to reschedule an event provided that written notice is given at
least seven (7) days before the original event date.
- 4.2 Rescheduling is subject to the availability of The Spot PH on the requested new date.
- 4.3 Only one (1) rescheduling request per booking will be honored at no additional
charge. Subsequent rescheduling requests will incur a rescheduling fee of five hundred pesos (PHP 500.00).
- 4.4 Rescheduling requests submitted with fewer than fifteen (15) days' notice may be
treated as a cancellation.
Cancellation by The Spot PH
- 4.5 In the unlikely event that The Spot PH must cancel a confirmed booking due to force
majeure, emergency, or other circumstances beyond its control, the Client will be notified as soon as
possible.
- 4.6 In such cases, The Spot PH will offer the Client an alternative date or a full refund
of all payments made.
5. EVENT DETAILS AND CLIENT RESPONSIBILITIES
- 5.1 Accurate Information: The Client is responsible for providing complete and accurate
event details, including the correct venue address, event type, expected guest count, and preferred package.
- 5.2 Venue Access: The Client must ensure that The Spot PH team has full and timely access
to the event venue for setup, operations, and breakdown. Standard setup time is one to two (1–2) hours
before the event, and breakdown requires at least one (1) hour after the event.
- 5.3 Venue Permits: The Client is responsible for obtaining all necessary permits,
authorizations, or venue approvals required for the service of alcoholic beverages at the event location.
- 5.4 Event Changes: Any changes to event details after Booking Confirmation must be
communicated in writing to The Spot PH admin at least fifteen (15) days prior to the event. Changes to guest
count, venue, or package are subject to revised pricing.
- 5.5 Guest Behavior: The Client is responsible for ensuring appropriate conduct among
event guests. The Spot PH staff reserves the right to cease service to any individual exhibiting disruptive,
aggressive, or inappropriate behavior.
- 5.6 Legal Drinking Age: In compliance with Philippine law, The Spot PH will not serve
alcoholic beverages to individuals under the age of eighteen (18). The Client must ensure that minors are
not presented for alcoholic beverage service.
6. SERVICE COVERAGE AND LIMITATIONS
- 6.1 The Spot PH provides mobile bar services within Metro Manila and nearby areas
including Cavite, Laguna, Bulacan, and Rizal. Events outside this service area may be subject to an
additional travel and logistics fee, which will be disclosed prior to booking confirmation.
- 6.2 The Spot PH will provide the agreed number of bartenders and bar setup as specified
in the confirmed package. Any request for additional bartenders, equipment, or extended service hours must
be communicated and agreed upon in writing before the event.
- 6.3 The Spot PH is not responsible for delays caused by circumstances beyond its control,
including but not limited to heavy traffic, inclement weather, natural disasters, or venue-related issues.
- 6.4 The Spot PH does not provide event furniture, tents, or additional event equipment
unless specifically included in the agreed package.
7. LIABILITY AND INDEMNIFICATION
- 7.1 The Spot PH shall not be liable for any personal injury, property damage, or loss
arising from the actions of event guests, venue conditions, or circumstances beyond its reasonable control.
- 7.2 The Client agrees to indemnify and hold harmless The Spot PH, its owner, staff, and
representatives from any claims, damages, or liabilities arising from the event, including claims related to
alcohol consumption by guests.
- 7.3 The Spot PH assumes no liability for the quality or safety of food or beverages not
provided by The Spot PH at the event.
- 7.4 In the event of equipment damage or loss caused directly by the negligence of The
Spot PH, the business will assume responsibility for repair or replacement.
- 7.5 In the event that equipment damage is caused by guests or third parties at the event,
the Client will be held financially responsible for repair or replacement costs.
8. PRIVACY AND DATA PROTECTION
- 8.1 By submitting the Booking Form, the Client consents to the collection and processing
of personal information, including name, contact details, event information, and payment records, for the
purpose of managing the booking and service delivery.
- 8.2 Client information will be kept strictly confidential and will not be shared with
third parties without the Client's written consent, except as required by law.
- 8.3 The Spot PH may use event photos taken during the engagement for promotional purposes
on its website and social media platforms. Clients who do not consent to the use of their event photos must
notify The Spot PH in writing prior to the event.
- 8.4 Data collected through the website is protected in accordance with applicable
Philippine data privacy regulations, including the Data Privacy Act of 2012 (Republic Act No. 10173).
9. INTELLECTUAL PROPERTY
- 9.1 All content on The Spot PH website, including text, images, logos, package designs,
and branding materials, is the exclusive intellectual property of The Spot PH and is protected under
applicable Philippine intellectual property laws.
- 9.2 Clients and website visitors may not reproduce, distribute, or use any content from
The Spot PH website without prior written permission from the business owner.
10. FORCE MAJEURE
The Spot PH shall not be held in breach of its obligations under a confirmed booking if the failure to
perform is caused by events beyond its reasonable control, including but not limited to natural disasters,
pandemics, government-imposed restrictions, civil unrest, severe weather conditions, or any other force
majeure event. In such cases, The Spot PH will make reasonable efforts to reschedule the engagement or offer a
partial refund at its discretion.
11. AMENDMENTS TO TERMS
The Spot PH reserves the right to update, amend, or modify these Terms and Conditions at any time without
prior notice. Changes will be effective immediately upon publication on the official website. It is the
Client's responsibility to review the Terms and Conditions prior to each booking. Continued use of the booking
system following any amendments constitutes acceptance of the revised terms.
12. GOVERNING LAW AND DISPUTE RESOLUTION
- 12.1 These Terms and Conditions shall be governed by and construed in accordance with the
laws of the Republic of the Philippines.
- 12.2 In the event of a dispute arising from or related to a booking or service agreement,
the parties agree to resolve the matter amicably through direct negotiation in good faith before pursuing
formal legal remedies.
- 12.3 If a resolution cannot be reached through negotiation, disputes shall be submitted
to the appropriate courts of the Province of Cavite, Philippines.
13. ACCEPTANCE OF TERMS
By submitting a booking request through The Spot PH website, clicking the confirmation checkbox on the
Booking Form, or proceeding with the payment of the required downpayment, the Client confirms that:
- (a) They have read and fully understood these Terms and Conditions;
- (b) They agree to be legally bound by the terms set forth herein;
- (c) They are of legal age and have the authority to enter into this agreement; and
- (d) The information provided in the Booking Form is accurate and complete to the best of
their knowledge.
